MY TRIPOD


I usually bring my tripod and cameras in my travels as I used to document people, places and events aside from my regular work. I even feature at times Philippine Airlines in the footages I took (which is public in nature) as part of my travel in Aklan and the, latest in Legaspi City. My tripod has been with me for more than four (4)years. It has a sentimental value because it was purchased by my mother as a gift when she was still alive and has been with me whenever I cover t.v. shows and important people and events.
I usually check my equipment upon arrival. However, last July 18, 2009 (file reference - MNLPR65961/18JUL09/0144GMT) my tripod was damaged and became useless as the clip, where the camera is being placed, was destroyed. The bolt was broken. It cannot be damaged ordinarily, if not for the carelessness of your personnel. That same day, I still have a project in the afternoon to cover and the day following my arrival. It was a Saturday (if I am not mistaken) and I shall be covering our house blessing the following day too aside from and invitation from a friend for his birthday. What an inconvenience it has caused.
The Customer Service Relations Officer at the airport asked me of the value of the tripod, which I answered at P 1,500.00. She was offering me said amount to settle the damages, but I disagreed. I said that it should be at P 3,000.00 considering the expenses when my mother bought said tripod, the inconvenience it has caused and loss of income.
I am a reasonable person, but I also believe that nobody can unjustly enrich themselves from another. I find it unacceptable to be indemnified only of the amount of the tripod for the negligence of your personnel, which has caused inconvenience, loss of income, not to mention the sentimental value of my equipment. I am just asking for fair and reasonable restitution to include other expenses when my mother bought it and for inconvenience it has cause.
I was informed that your representative shall get in touch with me regarding the matter. More than a week have elapsed and I have not received any call from your end.
Accordingly, let this served as my preliminary letter demand. I shall make the necessary legal demand to comply with the legal requirements under e-commerce law, should you disregard this letter.
I am reasonable person.
